2. Purpose and Relationship to Other Policies

This Legal Notice identifies the Site operator, explains important intellectual-property and informational-use notices, and provides information concerning formal legal communications.

It does not replace the agreements or Policies governing a particular purchase, Product, Service, Booking, Trip, Dive Activity, privacy matter, return, refund, shipment, payment obligation, or dispute.

The following documents govern their respective subject matters:

If Company documents appear to conflict, the order-of-precedence provision in Section 33.1 of the Terms of Service applies, subject to mandatory law.

3. Copyright, Trademarks, and Company Content

Neptune's Vanguard™, Company names, logos, branding, slogans, artwork, illustrations, graphics, photographs, videos, Site text, layouts, Product designs, downloadable materials, training materials, promotional materials, and other original Company content may be owned by, licensed to, or otherwise lawfully used by Neptune's Vanguard LLC and may be protected by applicable copyright, trademark, trade-dress, unfair-competition, and other intellectual-property laws.

Trademark Notices

The ™ symbol may be used with Neptune's Vanguard™ and other names, slogans, branding, or source identifiers for which trademark rights are claimed but that are not identified here as federally registered marks. The absence of a ™ symbol does not by itself constitute a waiver or abandonment of any rights that may exist.

The ® symbol is used only where registration has issued and use of the symbol is legally appropriate. Neptune's Vanguard Born of the Deep® is used with the registered-trademark symbol because federal registration has issued for that mark under U.S. Registration No. 8,444,966.

Third-Party Intellectual Property

Third-party names, trademarks, service marks, logos, photographs, Product images, copyrighted works, and other content remain the property of their respective owners.

Reference to a third party does not transfer ownership, grant a license, or imply sponsorship, endorsement, partnership, agency, or affiliation beyond a relationship expressly identified by Neptune's Vanguard.

4. Permitted and Prohibited Use of Company Content

Access to the Site does not transfer ownership of Company intellectual property or grant any license except the limited right to access and use the Site for its intended lawful purpose.

Except where expressly authorized by Neptune's Vanguard in writing or permitted by applicable law, Company intellectual property may not be:

• copied or reproduced;
• modified, altered, or translated;
• published, republished, or distributed;
• sold, licensed, sublicensed, or commercially exploited;
• used to create derivative works;
• scraped, harvested, or systematically extracted;
• used to train, develop, or improve an artificial-intelligence or machine-learning system where such use is prohibited by the Terms or applicable law;
• used in a manner that falsely suggests sponsorship, endorsement, affiliation, or authorization; or
• used in another manner prohibited by Section 22 of the Terms of Service.

5. Informational Content and No Professional Advice

Site content is provided for general commercial, educational, promotional, and informational purposes associated with Neptune's Vanguard Products and Services.

Information concerning scuba diving, snorkeling, boating, travel, Equipment, safety, emergency procedures, training, certifications, dive insurance, travel insurance, medical screening, or similar subjects does not by itself constitute:

• scuba certification or professional training;
• medical diagnosis, treatment, or clearance;
• a determination that a person is medically or physically fit to dive;
• insurance advice or a guarantee of coverage;
• emergency-response or rescue services;
• a guarantee that a Product or activity is suitable for a particular person; or
• a substitute for instructions, warnings, training standards, professional guidance, or medical evaluation applicable to the activity.

Customers and Participants remain responsible for the duties described in the Terms of Service, including Product safety, medical fitness, certification, training, insurance, and compliance with provider requirements.

6. Accuracy, Availability, and Site Changes

Neptune's Vanguard uses reasonable efforts to maintain accurate and useful Site information, but Product descriptions, images, prices, availability, sizing information, schedules, provider information, Trip details, links, policies, promotional information, and other Site content may contain errors, become outdated, or change.

The Company may correct, update, supplement, remove, suspend, or replace Site information prospectively as permitted by the Terms and applicable law.

Site access may also be interrupted because of maintenance, provider outages, technical problems, security events, updates, network conditions, or circumstances outside the Company's reasonable control.

The warranty provisions applicable to the Site, Products, Services, Bookings, and Trips are contained in Section 25 of the Terms of Service.

7. Third-Party Providers, Links, and Commercial Relationships

The Site may reference, integrate with, or link to independent Third-Party Providers, including Shopify, payment processors, manufacturers, fulfillment providers, shipping carriers, dive operators, instructors, divemasters, hotels, resorts, airlines, transportation providers, training agencies, insurers, environmental organizations, social-media platforms, technology providers, and other businesses or organizations.

Third parties operate under their own terms, privacy notices, warranties, policies, qualifications, operating procedures, and legal obligations.

A link, recommendation, listing, referral, integration, or mention does not guarantee the third party's performance and does not by itself create an employment, partnership, agency, joint-venture, fiduciary, or similar relationship.

Affiliate and Referral Relationships

Neptune's Vanguard may participate in affiliate, referral, ambassador, wholesale, promotional, discount, sponsorship, or other commercial relationships.

The Company may receive a commission, referral payment, discount, credit, Product, promotional benefit, or other compensation when a Customer purchases or interacts through certain links, codes, or relationships.

Where applicable law requires a particular affiliate, endorsement, sponsorship, or compensation disclosure, Neptune's Vanguard will provide that disclosure.

8. Submitted Material and Intellectual-Property Concerns

Do not submit confidential, proprietary, copyrighted, trademarked, personally identifying, or other protected material unless you possess the rights, permissions, authority, and releases reasonably necessary for the requested use.

Reviews, photographs, videos, artwork, logos, designs, custom-order materials, comments, and other Submitted Material are governed by Section 23 of the Terms of Service.

Reporting an Intellectual-Property Concern

If you believe material appearing on the Site infringes a copyright, trademark, or other intellectual-property right that you own or are authorized to enforce, send a written notice to support@neptunesvanguard.com.

Please include, where applicable:

• your full name and contact information;
• identification of the protected work, trademark, or other right involved;
• the specific Site page, URL, Product listing, image, or other location containing the material at issue;
• an explanation of the claimed infringement;
• an explanation of your ownership or authority to act for the rights holder;
• a good-faith statement that you believe the challenged use is not authorized by the rights holder, its agent, or applicable law;
• a statement that the information supplied in your notice is accurate; and
• your physical or electronic signature.

Neptune's Vanguard may request additional information, preserve relevant records, temporarily restrict or remove material during review, contact the person who supplied the material, restore material when appropriate, or take another action permitted by applicable law.

Formal dispute notices governed by Section 29 of the Terms of Service must satisfy the content, timing, and delivery requirements stated in that Section.

An Informal Dispute Notice to Neptune's Vanguard must be sent to both the support email address and the mailing address below:

A formal dispute notice should contain the information required by Section 29.2 of the Terms, including identification of the claimant, relevant transaction, factual and legal basis of the dispute, reasonably available supporting documentation, and requested relief.

10. Disputes, Governing Law, Venue, and Claim Periods

This Legal Notice does not create a separate dispute-resolution process.

Disputes concerning the Site, a Policy, Product, Service, Booking, Trip, Dive Activity, payment obligation, invoice, or relationship with Neptune's Vanguard are governed by the applicable provisions of the Terms of Service.

Informal Dispute Resolution and Court Proceedings

The applicable informal-dispute notice and court procedures are stated in Section 29 of the Terms of Service.

Governing Law and Venue

Governing law, personal jurisdiction, and venue are determined under Section 30 of the Terms of Service.

Except where federal law or mandatory law requires otherwise, the Terms provide for Pennsylvania law and the applicable Northampton County, Pennsylvania or United States District Court for the Eastern District of Pennsylvania venues described there.

Customer and Participant Claim Period

Customer and Participant claims may be subject to the contractual claim-period provisions contained in Section 31 of the Terms of Service, to the fullest extent permitted by applicable law.

This Legal Notice does not independently shorten, extend, waive, restart, or otherwise modify any contractual or statutory limitations period.

11. Privacy and Personal Information

Personal information collected through or in connection with the Site, Products, Services, Bookings, Trips, Dive Activities, customer communications, privacy requests, or other interactions is handled as described in our Privacy Policy.

Nothing in this Legal Notice creates a separate privacy regime or permits Neptune's Vanguard to waive, restrict, shorten, or condition a privacy, data-protection, security, breach-notification, regulatory, or consumer right that applicable law does not permit the parties to waive or modify.

Privacy requests should be submitted using the procedures identified in the Privacy Policy and Contact Information Policy.

12. Accessibility and Alternative Formats

Neptune's Vanguard seeks to make its policies and important Site information reasonably accessible.

13. Updates to This Legal Notice

Neptune's Vanguard may update this Legal Notice prospectively to reflect changes in applicable law, Company operations, Site content, intellectual property, providers, contact information, or business practices.

The “Last Updated” date identifies the current version.

An update to this Legal Notice does not retroactively alter an accepted transaction, waive an existing right, alter an existing Dispute, or override notice, consent, or other requirements imposed by applicable law.
