2. Purpose and Relationship to Other Policies

This Legal Notice identifies the Site operator, states important intellectual-property and informational-use notices, and explains where formal communications may be directed. It does not replace the agreements governing a transaction or activity.

Access to and use of the Site are governed by the Terms of Service. Personal information is handled as described in the Privacy Policy. Physical fulfillment is governed by the Shipping Policy, and returns, refunds, and Trip cancellations are governed by the Return and Refund Policy. The order-of-precedence provision in the Terms resolves conflicts among these documents, subject to mandatory law.

3. Copyright, Trademarks, and Site Content

Neptune's Vanguard™, Neptune's Vanguard Born of the Deep™, Company logos, branding, slogans, artwork, graphics, photographs, videos, Site text, layouts, Product designs, downloadable materials, training materials, and other original content are owned by or licensed to Neptune's Vanguard LLC and are protected by applicable copyright, trademark, trade-dress, and other laws. Use of the ™ symbol, or absence of a symbol, does not waive any rights. No registered-trademark symbol is claimed unless and until an applicable registration has issued.

Except as expressly authorized in writing or permitted by law, no person may copy, reproduce, modify, translate, distribute, publish, display, sell, license, scrape, create derivative works from, train a model on, or commercially exploit Company intellectual property. A reasonable personal copy of a policy, receipt, Booking record, or transaction document may be retained for reference.

Third-party names, marks, photographs, products, and content remain the property of their respective owners. A reference or link does not transfer ownership, grant a license, or imply sponsorship, endorsement, agency, or partnership beyond a relationship expressly disclosed by the Company.

4. Informational Content; No Professional Advice

Site content is provided for general commercial and informational purposes. It is not legal, medical, health, insurance, immigration, financial, engineering, or other professional advice and should not be relied upon as a substitute for advice from an appropriately qualified professional.

Content concerning scuba diving, snorkeling, travel, Equipment, safety, training, emergencies, or insurance does not constitute certification, instruction, medical clearance, rescue services, a fitness determination, or a guarantee that an activity or Product is suitable for a particular person. Participants and Customers remain responsible for following Product instructions and warnings, obtaining appropriate training and medical evaluation, maintaining required certification and insurance, and exercising independent judgment as stated in the Terms of Service.

5. Accuracy, Availability, and Changes

We use reasonable efforts to maintain accurate Site information, but Product descriptions, images, prices, availability, provider information, schedules, Trip details, links, and general content may contain errors or become outdated. Site content may be corrected, updated, suspended, or removed prospectively as permitted by the Terms and applicable law.

Nothing in this Legal Notice creates a warranty, guarantee, offer, professional duty, or contractual modification beyond an express written commitment accepted under the Terms. Mandatory warranties and consumer rights remain unaffected.

6. Third-Party Providers, Links, and Disclosures

The Site may reference or link to Shopify, payment providers, fulfillment providers, manufacturers, dive operators, hotels, resorts, transportation providers, training agencies, insurers, environmental organizations, social-media platforms, and other independent entities. Their own terms, privacy notices, qualifications, availability, and legal obligations apply to their services.

The Company may receive a commission, referral fee, discount, promotional benefit, or other compensation when a Customer uses certain links or codes. Any relationship requiring disclosure will be disclosed as required by law. Compensation does not guarantee a third party's performance or make the Company an insurer of that provider.

7. Submitted Material and Intellectual-Property Concerns

Do not submit confidential, proprietary, copyrighted, trademarked, or personal material unless you have the rights and permissions required for the requested use. Reviews, custom artwork, photographs, designs, and other Submitted Material are governed by Section 23 of the Terms of Service.

If you believe content on the Site infringes your copyright, trademark, or other intellectual-property right, email support@neptunesvanguard.com with:

  • your name and contact information;
  • identification of the protected work, mark, or right;
  • the exact Site location of the material at issue;
  • an explanation of the claimed infringement and your authority to act;
  • a good-faith statement that the challenged use is not authorized by the rights owner, its agent, or law; and
  • a statement that the information supplied is accurate, together with your physical or electronic signature.

We may request additional information, remove or restrict material during review, notify the person who supplied it, or take another action permitted by law. This contact process does not admit infringement, waive a defense, or represent that the Company has appointed an agent for any statutory safe-harbor program.

8. Formal Legal Notices and Service of Process

Questions about this Legal Notice may be sent to support@neptunesvanguard.com. Formal dispute notices must comply with the content, timing, and delivery requirements of Section 29 of the Terms of Service and should be sent to both the email and mailing address stated above.

Emailing customer support does not by itself constitute valid service of process, waive a defense, extend a deadline, alter an agreement, or create an admission of liability. Service of process must comply with applicable law unless the Company expressly agrees otherwise in writing.

9. Dispute Resolution, Governing Law, and Venue

Disputes involving the Site, a Policy, Product, Service, Booking, Trip, or Dive Activity are governed by the informal dispute-resolution and court-proceeding provisions in Section 29 of the Terms of Service.

Except for federal law and mandatory law that cannot be displaced, Pennsylvania law governs as stated in Section 30 of the Terms. Court proceedings arising under the Terms are subject to the Northampton County, Pennsylvania and Eastern District of Pennsylvania venue provisions, while non-waivable venue rights and applicable foreign-provider rules remain unaffected.

11. Updates

We may update this Legal Notice prospectively. The "Last Updated" date identifies the current version. Changes do not retroactively modify an accepted transaction, waive an existing right, or override notice or consent required by applicable law.
